The National Defense Authorization Act for Fiscal Year 2006, Public Law 109-163, was enacted January 6, 2006, and has some provisions that impact military retired pay.

Concurrent Receipt of Veterans Disability Compensation and Military Retired Pay: A retiree who has been rated as unemployable by the Department of Veterans Affairs will be entitled to full concurrent receipt effective October 1, 2009.

Other proposals such as advancing 30 years paid-up SBP to October 2005 rather than October 2008, and elimination of the DIC offset for annuitants were not covered in this legislation.
